These general terms and conditions apply to the services of CloudEngagePro.com, a trade name of OnlineMarketingMan.net, hereinafter referred to as "CloudEngagePro". By using our website and services, you agree to these terms and conditions.

2. Applicability

These terms and conditions shall apply to all offers, quotations and agreements where CloudEngagePro provides services to clients, unless otherwise agreed in writing.

3. Services

CloudEngagePro provides strategic and functional consulting related to Salesforce Marketing Cloud (Account Engagement), data strategy, integrations and marketing automation optimization. Services are provided on a project basis or through consulting agreements.

4. Offers and Agreements.

Quotes are without obligation unless explicitly stated otherwise. An agreement is established when CloudEngagePro provides written or email confirmation of the order.

5. Rates and Payment.

Rates are agreed upon in advance. Payment must be made within 14 days of the invoice date, unless otherwise agreed. If the term of payment is exceeded, the client is automatically in default.

6. Liability

CloudEngagePro shall not be liable for indirect damages, consequential damages or lost profits. Liability is limited to the amount paid for the relevant service or up to the amount paid by the liability insurance.

7. Intellectual Property

All intellectual property rights to any advice, documents, reports or materials delivered shall remain with CloudEngagePro, unless expressly agreed otherwise in writing.

8. Confidentiality

Both parties agree to maintain the confidentiality of all confidential information shared during the course of the collaboration.

9. Privacy and Data Processing

CloudEngagePro processes personal data in accordance with applicable AVG legislation. See our Privacy Statement for more information.

10. Disputes and Applicable Law.

These terms and conditions are exclusively governed by Dutch law. Any disputes will be submitted to the competent court in Limburg, unless mandatory law requires otherwise.
